2.1 Product Descriptions

We take reasonable steps to describe and display our Products accurately. However, photographs, illustrations, videos, measurements, colors, finishes, textures, and other visual representations are provided for general reference.

The appearance of a Product may vary depending on screen settings, lighting conditions, manufacturing batches, materials, photography, and other factors outside our control.

Minor variations that do not materially affect a Product’s function or overall character will not necessarily constitute a defect.

2.2 Natural Materials and Outdoor Products

Certain Products, including outdoor furniture, wooden structures, storage sheds, timber Products, and Products made from natural materials, may display natural variations in grain, texture, knots, tone, pattern, or finish.

Natural materials may also change in appearance over time due to sunlight, moisture, temperature, humidity, weather exposure, maintenance, and ordinary use.

  • the Product complies with any applicable planning, building, zoning, safety, lease, landlord, or homeowners’ association requirements.

2.4 Assembly and Installation

Where appropriate, assembly or installation should be performed by a competent and suitably qualified person.

2.5 Foundations, Ground Preparation, and Utilities

For sheds, structures, and other Products requiring a prepared site, you are responsible for ensuring that the site is level, stable, adequately drained, accessible, and otherwise suitable before delivery or installation.

You must identify and protect underground or concealed utilities, pipes, cables, drainage systems, and other infrastructure before any ground preparation, drilling, anchoring, or installation takes place.

2.6 Permits and Approvals

You are responsible for determining whether planning permission, a building permit, landlord approval, homeowners’ association approval, or any other consent is required before purchasing, placing, assembling, or installing a Product.

Unless we expressly agree otherwise in writing, TERKKIN does not obtain permits or approvals on your behalf.

2.7 Weather Conditions and Product Security

Outdoor Products must be assembled, installed, secured, anchored, maintained, and used in accordance with the manufacturer’s instructions.

Unless expressly advertised as suitable for a particular condition, Products are not represented as being suitable for extreme winds, storms, flooding, heavy snow loads, fire exposure, seismic activity, or other severe conditions.

You are responsible for taking reasonable precautions to protect Products during adverse weather, including closing or securing doors, covers, parasols, canopies, lids, and movable components.

3.1 Placing an Order

An automated order acknowledgement confirms only that we have received your order. It does not necessarily mean that your order has been accepted.

A binding purchase contract is formed only when we expressly confirm acceptance of the order or dispatch the Products, depending on the process described in your order confirmation.

3.2 Order Acceptance and Refusal

We may accept, reject, limit, or cancel an order where reasonably necessary, including where:

  • a Product is unavailable;
  • pricing or Product information contains an obvious error;

  • we reasonably suspect fraud or unauthorized activity;
  • delivery is unavailable to the requested address;
  • an order exceeds applicable quantity limits;
  • fulfilling the order would violate applicable law.

Where we reject or cancel an order after payment has been collected, we will refund the relevant amount using the original payment method, subject to applicable law.

3.3 Reviewing Your Order

You are responsible for reviewing Product selections, quantities, dimensions, finishes, delivery information, and other order details before submitting an order.

Please contact us promptly if you need to request a change or cancellation. We cannot guarantee that an order can be changed or cancelled once processing, customization, production, packing, or dispatch has begun.

3.4 Custom and Made-to-Order Products

Products that are custom-made, personalized, altered, cut to size, specially ordered, or manufactured according to customer specifications may not be cancelled or returned after production has begun, except where the Product is defective or the law provides otherwise.

3.5 Returns and Exchanges

Returns, exchanges, cancellations, and refunds are governed by our Refund Policy:

3.6 Personal Use and Resale

Unless we expressly agree otherwise in writing, Products are offered for personal or household use and not for unauthorized commercial resale, distribution, or export.

Delivery, handling, assembly, installation, customs, import, remote-location, failed-delivery, or other applicable charges will be disclosed before checkout or otherwise communicated to you before the order is accepted.

You are responsible for customs duties, import taxes, brokerage charges, and similar governmental charges where these are not expressly included in the price.

4.3 Promotions

  • discounts cannot be applied retrospectively;

You agree to provide accurate, current, and complete billing, payment, and account information.

By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize the relevant charges.

Payment processing may be provided by third-party payment providers and may be subject to their separate terms and privacy policies.


SECTION 5 — SHIPPING, DELIVERY, AND COLLECTION

5.1 Delivery Estimates

Delivery dates and times are estimates unless we expressly confirm a guaranteed delivery service in writing.

We will take reasonable steps to deliver within the estimated period, but delays may occur due to Product availability, manufacturing, carrier operations, customs procedures, weather, road restrictions, access problems, labor disruptions, or other circumstances outside our reasonable control.

Nothing in this section excludes rights or remedies that cannot legally be excluded.

5.2 Delivery Information and Access

You are responsible for providing a complete and accurate delivery address, contact details, access information, and any relevant delivery restrictions.

Before placing an order, you must ensure that the delivery vehicle and delivery personnel can safely access the delivery location.

Large Products, including sheds, structures, furniture sets, and storage units, may require additional delivery access, assistance, or specialist handling.

5.4 Failed or Refused Delivery

Additional charges may apply where delivery cannot be completed because:

  • the Product does not fit through the available access route;
  • delivery is refused without a valid legal reason.

5.5 Inspection on Delivery

You should inspect the packaging and Products as soon as reasonably possible after delivery.

Failure to report an issue immediately does not remove any mandatory legal rights, but prompt notice may help us investigate and resolve the matter.

5.6 Title and Risk of Loss

Risk of loss or damage will pass to you at the time required by applicable law and as further described in our Shipping Policy.

For many consumer transactions, risk should remain with TERKKIN until the customer or an authorized recipient takes physical possession of the Products.

SECTION 6 — INTELLECTUAL PROPERTY

6.1 Ownership

The Services and their contents—including trademarks, business names, logos, text, Product descriptions, photographs, illustrations, graphics, videos, audio, software, page layouts, and design elements—are owned by or licensed to TERKKIN and are protected by applicable intellectual property laws.

6.2 Permitted Use

You may access and use the Services for lawful, personal, and non-commercial purposes.

Without our prior written permission, you may not:

  • copy, reproduce, republish, distribute, or publicly display Store content;
  • modify or create derivative works from Store content;
  • download or store substantial portions of the Store;
  • use Product photographs or descriptions for resale or commercial purposes;

This restriction does not prevent acts that cannot lawfully be restricted.

The TERKKIN name, logos, Product names, designs, and slogans are trademarks or other protected identifiers belonging to TERKKIN or its licensors.

Shopify’s name, trademarks, logos, and related branding belong to Shopify or its licensors.

Other names and trademarks appearing through the Services belong to their respective owners. No trademark may be used without the permission of its owner.


SECTION 7 — THIRD-PARTY TOOLS AND SERVICES

We may provide access to tools, applications, payment services, maps, reviews, delivery-tracking systems, or other features supplied by third parties.

We do not control every third-party tool and do not guarantee that it will be continuously available, secure, accurate, or suitable for your requirements.

Third-party tools are provided subject to the relevant provider’s terms and privacy practices. Your use of them is at your own discretion and risk, except where liability cannot legally be excluded.

We may add, replace, modify, or discontinue optional tools and features from time to time.


The Services may contain links to websites, content, or services operated by third parties.

A link does not necessarily mean that we endorse, control, or verify the third-party website or its content. We are not responsible for third-party websites, products, services, security practices, or privacy practices.

Before purchasing from or providing information to a third party, you should review its applicable terms and policies.

Questions or complaints concerning third-party products or services should normally be directed to the relevant third party.


SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our Store is hosted by Shopify, which provides the technology platform used to operate the Services.

You confirm that:

  • you own the User Content or have permission to provide it;
  • the User Content is accurate to the best of your knowledge;

We may suspend, restrict, or terminate your account or access to the Services where:

  • we reasonably suspect fraud, abuse, or unlawful activity;
  • your activity creates a security, operational, or legal risk;
  • payment remains outstanding;
  • we are required to do so by law or by a competent authority;
  • we discontinue the relevant Service.

Termination does not affect rights or obligations that arose before termination.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or breach of mandatory consumer rights.

Subject to the preceding paragraph and to the maximum extent permitted by law, Terkkin will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the purchase contract was formed.

This may include loss of profit, revenue, business opportunity, anticipated savings, goodwill, or data.


SECTION 17 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to compensate TERKKIN for losses, liabilities, damages, and reasonable legal costs arising directly from:

  • your unlawful use of the Services;
  • your material breach of these Terms;
  • your infringement of another person’s rights;
  • User Content submitted by you that violates applicable law or these Terms.

This obligation will not apply to the extent that a claim results from TERKKIN’s own negligence, breach, unlawful conduct, or failure to take reasonable steps to reduce its loss.

We will notify you of a relevant third-party claim within a reasonable period and provide reasonable information concerning the claim.

Any control of the defence or settlement must be exercised reasonably. No settlement imposing non-monetary obligations on you may be entered into without your consent, which must not be unreasonably withheld.


SECTION 18 — SEVERABILITY

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable.

If it cannot be made enforceable, it will be severed from these Terms. The remaining provisions will continue in effect.

A failure or delay by either party to exercise a right under these Terms does not waive that right.

SECTION 24 — PRODUCT SAFETY, CARE, AND MAINTENANCE

You must follow all assembly, anchoring, installation, operating, care, maintenance, and safety instructions supplied with a Product.

You should inspect outdoor furniture, sheds, storage structures, fasteners, hinges, anchors, roofs, doors, panels, and supporting surfaces periodically for wear, movement, corrosion, damage, instability, or loose components.

Products must not be used where they are damaged, unstable, incorrectly assembled, inadequately anchored, overloaded, or otherwise unsafe.

Children must be supervised around Products where appropriate. Products must not be climbed on, altered, used as playground equipment, or used for an unintended purpose unless expressly designed for that use.
